A gay Staten Island caterer says cops who were captured on video taking him down in his front yard, beat him while shouting homophobic slurs, the Daily News has learned.

Louis Falcone, 31, wasn’t charged as a result of the June 19 takedown, and now plans to sue in federal court for civil rights violations, lawyer Eric Subin said.

“How can you do that – four people on one skinny, scrawny little guy?” Subin asked. “They’re criminals; they belong behind bars.”

Falcone, all of 150 pounds, told the Daily News that the officers pulled him out of the Midland Beach home he shares with his mom while investigating a noise complaint at 5:30 a.m.

He says they roughed him up while calling him a “f**”and a “f****t.”

Anti-homosexual slurs aren’t audible on the video, which was taken from across the street and was viewed by the Daily News. “While I was on the ground, I had mud and blood in my mouth,” he said. “One (of the cops) said, ‘Don’t let it get on you, he probably has AIDS, the f****t.’”

The NYPD didn’t immediately respond to requests for comment.

Steel magnate Leroy Schecter recently slashed the price of his $95 million penthouse at 15 Central Park West to $55 million. But one of his neighbors, who owns a duplex condominium at the property, reckons they can do better with their pad, even though it’s smaller. This anonymous seller bought the duplex for $48 million just a year ago, and is now listing it for a whopping $65 million. The four-bedroom pad on the 18th and 19th floors of the Zeckendorf-developed building was scooped up last year for $48 million by a Chicago-based LLC, earning it the distinction as the second-most expensive condo ever sold at the exclusive building. Despite showing no obvious signs of renovation, the owner is hoping for a profit of $17 million, according to the New York Observer. Broker Janice Chang of Douglas Elliman has the listing. Chang will have to figure out how to convince a seller to buy the 5,610-square-foot condo unit for nearly $11,600 per square foot, when Schecter’s 6,000-square-foot digs on the entire 35th floor are also up for grabs, for less than $9,200 a foot. Perhaps it’s a matter of maintaining tradition. The late Richard Ullman had originally asked for $62.5 million when he sold the apartment, which features a wood-burning fireplace and 392-foot terrace, to the mystery buyer in May 2014.

5TH AVENUE HAS NYC’S HIGHEST PRICES PERIOD!

In this competition, it pays to place fifth.

In an analysis of numbered streets and avenues, Spread Sheet found that homes across the U.S. listed on Fifth Avenue and Fifth Street have the highest median asking price, compared with other homes listed on First through Tenth.

Of the roughly 40,000 current listings on realtor.com, homes, condos and townhomes listed for $1 million or more on Fifth Avenue/Street have a median listing price of $2.25 million, according to the real-estate listings website.

New York’s Fifth Avenue—with luxury shopping, world-class museums and views of Central Park—commands some of the highest prices in New York. “If Central Park was built one avenue over, then Sixth Avenue would have been the street,” said Jennifer Ireland, a real-estate broker with New York City-based Brown Harris Stevens. Without the New York listings in the mix, Fifth Avenue and Fifth Street drop to third place in the median asking price ranking.

TEEN MOM HAS DEAD BABY IN HER BAG WHILE SHOPLIFTING!

The teen mom caught with a dead newborn in a shopping bag in 2013 while allegedly shoplifting at a Victoria’s Secret was charged with murdering the baby boy on Thursday.

Tiona Rodriguez, 18, of Brooklyn, “carried out the murder of her newborn infant and then callously shoved him in a bag with the plan of — in her words to ‘take this s— and dig a hole, put it somewhere, lol, then we go eat IHOP,” prosecutor Rachel Ferrari said at her arraignment on a second-degree murder charge.

The charge, filed nearly two years after the baby’s death, stems from Rodriguez’s bizarre Oct. 16, 2013, shoplifting arrest.

She was charged with lifting a $44.50 pair of skinny jeans from the Herald Square store.

NYC’S TOP CONDO FLIPS!

Talk about seller’s remorse. Had the owner of the penthouse at 101 West 87th Street sat tight for just a few months longer, they might be $2 million richer. And that seller is hardly alone – an analysis by The Real Deal found that the 10 most lucrative Manhattan flips netted flippers over $11 million in the past year. There were 34 “arm’s length” condo flips in the city for properties worth more than $300,000, according to data from the city’s Department of Finance analyzed by The Real Deal. The data details condos in Manhattan buildings with 11 units or more, purchased between July 2014 and June 2015. Buyers sold those condos within the same year.

CHILD PORN CHARGES FOR “LAW AND ORDER” TV DIRECTOR!

TV director Jason “Jace” Alexander was busted on child-porn charges for allegedly promoting a video showing a girl stripping and masturbating, according to the Westchester County DA’s office.

Alexander, 50, of Dobbs Ferry, the only son of actress Jane Alexander, is accused of promoting the video – depicting a girl about 12 or 13 years old – by making it available for viewing in late June on the Torrent network, according to a criminal complaint.

He also is accused of having a video file depicting a 6- to 8-year-old girl performing a sexual act on herself, according to Investigator Andrew Garcia of the DA’s High Technology Crime Bureau.

Alexander was charged with felony counts of promoting and possessing an obscene sexual performance by a child. He posted $10,000 bail and is due in Dobbs Ferry Court on Nov. 19.
